LEGAL EFFECTS OF DECLARATION OF STATE OF CALAMITY

UNDER RA 7581(PRICE CONTROL LAW)

Sec. 6. Automatic Price Control. - Unless otherwise declared by the President, prices of basic necessities in an area shall automatically be frozen at their prevailing prices or placed under automatic price control whenever:

    (1) That area is proclaimed or declared a disaster area or under a state of calamity;

    (2) That area is declared under an emergency;

    (3) The privilege of the writ of habeas corpus is suspended in that area;

    (4) That area is placed under martial law;

    (5) That area is declared to be in a state of rebellion; or

    (6) A state of war is declared in that area.

If the prevailing price of any basic necessity is excessive or unreasonable, the implementing agency may recommend to the President the imposition of a price ceiling for the sale of the basic necessity at a price other than its prevailing price.

Unless sooner lifted by the President, price control of basic necessities under this section shall remain effective for the duration of the condition that brought it about, but not for more than sixty (60) days.

The terms "disaster" and "calamity" shall include those brought about by natural or man-made causes, whether local or foreign.

UNDER THE MAGNA CARTA FOR PUBLIC HEALTH WORKERS

SEC. 21. Hazard Allowance. - Public health worker in hospitals, sanitaria, rural health units, main centers, health infirmaries, barangay health stations, clinics and other health-related establishments located in difficult areas, strife-torn or embattled areas, distresses or isolated stations, prisons camps, mental hospitals, radiation-exposed clinics, laboratories or disease-infested areas or in areas declared under state of calamity or emergency for the duration thereof which expose them to great danger, contagion, radiation, volcanic activity/eruption occupational risks or perils to life as determined by the Secretary of Health or the Head of the unit with the approval of the Secretary of Health, shall be compensated hazard allowance equivalent to at least twenty-five percent (25%) of the monthly basic salary of health workers receiving salary grade 19 and below, and five percent (5%) for health workers with salary grade 20 and above. 

Release of national calamity funds.

The release of local funds which has been allocated in the budget for contingencies constituting 5% of the estimated earnings of the local government unit concerned.

The program provides financial assistance to Pag-IBIG member-victims in calamity-stricken areas.

BORROWER ELIGIBILITY

  • Member must have made at least 24 monthly contributions;
  • Member is actively paying contributions at the time he applies for a loan, and commits to continuously remit contributions for the term of the loan.
  • A resident of the area which is declared calamity-stricken.
